1. We respect your privacy

Aileen Mathyssen t/as Thrive Together Therapy (Thrive Together Therapy, We, Our) respects your right to privacy and is committed to safeguarding the privacy of our customers and clients. We adhere to the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) and, where applicable, the Notifiable Data Breaches scheme. This Privacy Policy sets out how we collect, use, disclose, store, secure and handle your personal information.

‘Personal information’ has the meaning given in section 6 of the Privacy Act 1988 (Cth), being information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

2. Collection of personal information

(a) Thrive Together Therapy will, from time to time, receive and store the personal information you provide to us directly or give to us in other forms. We will only collect personal information that is reasonably necessary for one or more of our functions or activities, including providing services to you.

(b) You may provide basic information such as name, phone number, address, email address, relevant child name, age and gender, to enable us to send information, provide updates, provide services to you and/or process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference. Where practicable, we will collect personal information directly from you. If we collect personal information about you from a third party, we will take reasonable steps to notify you in accordance with APP 5.

(c) Additionally, we may collect any other information you provide while interacting with us, provided such collection is reasonably necessary for our functions or activities or you have consented to the collection.

3. How we collect your personal information

Thrive Together Therapy collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you purchase a program from us and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

4. Use of your personal information

(a) Thrive Together Therapy may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you (direct marketing). We may use your personal information to improve our products and services and better understand your needs. We will only use or disclose your personal information for the purpose for which it was collected, or for a related secondary purpose where you would reasonably expect us to do so, unless we have your consent or an exception under the APPs applies.

(b) Thrive Together Therapy may use data collected for research purposes, but will only do so once any applicable personal information is deidentified and anonymised.

(c) Thrive Together Therapy may contact you by a variety of measures including, but not limited to telephone, email, or mail. For direct marketing communications, you have the right to opt- out at any time by contacting us at hello@busy-brains.com.au or by using the unsubscribe mechanism provided in our marketing communications. We will process your opt-out request within a reasonable timeframe (and in any event within 30 days) and will not charge you for making an opt-out request.

5. Disclosure of your personal information

(a) We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Privacy Policy. Personal information is only supplied to a third party when it is required for the delivery of our services or where otherwise permitted under the APPs. We take reasonable steps to ensure that these third parties are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

(b) We may, from time to time, need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, or warrant, in the course of a legal proceeding or in response to a law enforcement agency request.

(c) Information that we collect may from time to time be stored, processed in, or transferred to countries outside of Australia, such countries to be determined based on our services and our service providers. Where we disclose personal information to overseas recipients, we will take reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to that information, which may include ensuring they are subject to a law or binding scheme substantially similar to the APPs, or obtaining your consent to the disclosure after informing you that APP 8.1 will not apply. Thrive Together Therapy remains accountable for any breaches of the APPs by overseas recipients unless an exception under APP 8.1 or 8.2 applies.

(d) If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer, to the extent permissible at law, our user databases, together with any personal information and non-personal information contained in those databases. Where reasonably practicable, we will notify you before your personal information is transferred and becomes subject to a different privacy policy. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality and comply with privacy obligations equivalent to those in this Privacy Policy. The purchaser will be required to continue to handle your personal information in accordance with the APPs. We would seek to only disclose information in good faith and where permitted by law.

(e) By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Privacy Policy. Where we rely on your consent, you may withdraw your consent at any time by contacting us at hello@busy-brains.com.au. When we disclose your personal information to third parties, we will take reasonable steps to ensure that the third party is bound by obligations to protect your personal information in accordance with the APPs.

6. Security of your personal information

(a) Thrive Together Therapy is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

(b) The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us. Although we take reasonable steps to safeguard against unauthorised disclosures of information in accordance with APP 11.1, we cannot provide absolute assurance that personal information will never be disclosed in an unauthorised manner. In the event of a data breach that is likely to result in serious harm to any individuals whose personal information is involved, we will comply with our obligations under the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner as required by law.

7. Access to your personal information

(a) You may request access to personal information that we hold about you in accordance with APP 12 and the provisions of the Privacy Act 1988 (Cth). We will respond to your request within 30 days from receipt. We will not charge you for making a request but may charge a reasonable fee for giving access if a substantial amount of time is required to locate, compile or provide the information. We will notify you of any applicable charges before processing your request. If you would like to access the personal information we hold about you or believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us at hello@busy-brains.com.au.

(b) We may refuse to provide you with access to your personal information in certain circumstances set out in the Privacy Act 1988 (Cth), including where: (a) giving access would be unlawful; (b) denying access is required or authorised by law; (c) giving access would be likely to prejudice law enforcement activities, legal proceedings, or negotiations; (d) giving access would reveal our commercially sensitive decision-making processes; (e) giving access would be likely to prejudice enforcement activities; or (f) giving access would pose a serious threat to life, health or safety. If we refuse your request for access, we will provide you with written reasons for the refusal (except to the extent it would be unreasonable to do so) and inform you of the mechanisms available to complain about the refusal.

8. Complaints about privacy

If you have any complaints about our privacy practices, please send details of your complaints to Thrive Together Therapy by email to hello@busy-brains.com.au. We take complaints very seriously and will acknowledge receipt of your complaint within 7 days and investigate and respond to your complaint within a reasonable period (usually within 30 days). If you are not satisfied with our response, you have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC) by calling 1300 363 992, visiting www.oaic.gov.au, or writing to GPO Box 5218, Sydney NSW 2001.

When you come to our website www.busy-brains.com.au we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.

10. Changes to Privacy Policy

Please be aware that we may change this Privacy Policy in the future. We may modify this Privacy Policy at any time, in our sole discretion. Where changes are material and may affect how we handle your personal information, we will take reasonable steps to notify you by sending you an email notification, or other appropriate means. Material modifications will be effective 30 days after we provide notice of the changes. We will update the ‘Last Updated’ date on this Privacy Policy when changes are made.
